TERMS AND CONDITIONS:

1. Content. Customer warrants that all content hosted on Customer's web site is legal in the United States of America and in the states thereof and that no pornographic material will be hosted. Customer warrants that material presented on this site does not violate or infringe upon the copyright, trademark, or other proprietary interest of any entity.
2. No Spamming. Customer agrees not to use this domain in any bulk email effort involving unsolicited email sent in mass to lists purchased or collected without the end-users' permission to use their email addresses for this purpose.
3. Software Installations. Resource Marketing, Inc. dba RM1.net [RM1] does not charge for software as we provide open source solutions. Any installation charges are billed on a time basis only and are based upon a standard hourly rate. RM1 makes no warranties about the continued efficacy of either software installations or custom programming. Operating environments may change periodically due to security and other updates that may impact functioning of previously installed code.
4. Indemnification. Customer agrees to indemnify and defend RM1 and hold RM1 harmless from any legal actions, loss, claims, expense, liability or damages which RM1 may incur which in any way is caused by Customer's web site or use of email.
5. Interruption of Service. RM1 shall not be responsible for momentary network outages due to mechanical, programming, backbone, or any other failures of hardware, software, or human error. Customer agrees to back up their own domain, including all data uploaded and otherwise stored on Resource Marketing servers and keep their own local copy for backup and restoration.
6. At-will Agreement. This is an at-will agreement which can be terminated by either party upon 30 days written notice. Customer shall be responsible for retrieval of all HTML and graphics files stored on Resource Marketings's servers. In no way shall Resource Marketing be responsible for any Customer's files once an InterNIC domain transfer template has been acknowledged.
7. No Warranties. RM1 MAKES NO EXPRESS OR IMPLIED WARRANTY REGARDING ITS SERVICES. THE LIABILITY OF RM1 IN ANY EVENT SHALL NOT EXCEED ONE MONTH'S SERVICE CHARGE AND RM1 SHALL NOT BE LIABLE FOR ANY OTHER DAMAGES INCLUDING, BUT NOT LIMITED TO, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.
